The increased presence of artificial intelligence (AI) in the legal sphere has been a controversial topic in discussions about access to justice. While some claim that AI will act as a great equalizer — ringing in a new age of AI-powered legal assistance for those who most need it — its rise to fame in the legal field instead seems to be catalyzing the opposite reality.[1] As private AI companies increasingly dominate the practice of law, we are beginning to enter an era of unchecked digital capitalism, where the legal field’s most underserved participants are increasingly falling behind the technological curb.

Unequal Access to AI Services

The average person’s exposure to AI is not an accurate representation of the kind of technology that is being used in professional spheres. While a lawyer using a popular AI chatbot is not unheard of (one has to look no further than the B.C. lawyer who cited fake cases generated by ChatGPT in a 2023 divorce case), the kind of legal AI largely used by firms is much more sophisticated, much more efficient, and much more expensive than any publicly available service.[2]

Private legal AI tools that increase speed, efficiency, and accuracy in areas such as e-discovery, legal research, and document automation are being increasingly used by big firms.[3] These tools can perform repetitive, time consuming tasks accurately and in a fraction of the time taken by humans.[4] As this technology continues to advance, AI tools that can do everything from answering routine legal inquiries to generating entire legal arguments are said to be the future standard of legal practice, and lawyers have reported using tools offering some of these capabilities.[5] By effectively replacing many of the tasks traditionally performed by junior lawyers and expediting timelines, legal AI allows professionals to focus their expertise on making the strongest arguments possible — giving them an undeniable edge over those who spend human labour on now-automatable tasks.[6] There is said to be a catchphrase going around the professional community: “AI won’t replace lawyers, but lawyers who use AI will replace lawyers who don’t.”[7]

For big firms and those with the money to hire these firms’ attorneys, these advancements are nothing short of revolutionary. AI’s positioning in the private sector, however, makes it a money game — those who can’t afford legal representation from these firms are unable to benefit from this innovation. While certain public sector organizations and nonprofits offer simple AI tools to increase access to legal information, these tools are nowhere near as sophisticated as those seen in the professional world.[8] This is causing the digital divide to widen at an unprecedented rate, which has concerning implications for people who self-represent, and access to justice as a whole.

The Digital Divide and Implications for Self-Represented Litigants

The tech companies at the forefront of legal AI development are not creating services with the aim of increasing access to justice. Rather, they are interested in making a profit by selling expensive products to the wealthy actors willing to pay for them.[9] As a result, those who can’t pay to play are largely excluded from the fruits of these technological advancements. This inherently problematic structuring of access to technology is an example of digital capitalism, which has been defined as, “the introduction of profit-driven digital processes of outsourcing, automatisation, dispersion, and commodification in the practice of law.”[10]

Big firms adopting new AI tools might initially appear innocuous, but the steadily increasing presence of private tech companies in the public legal sphere will have systemic impacts.[11]As technology advances at breakneck speed, and firms become desperate to edge out their competitors with the latest tools, the ability to offer the best legal services will no longer be a simple matter of how good a firm’s attorneys are: it instead becomes a game of who can access the best and brightest technology.

This commodification might cause lawyers to move away from being defenders of public interest and instead shift to become “one-dimensional businessmen of law” who value the protection and expansion of their markets above all else.[12] As private competition increases, the legal profession threatens to become increasingly fixated on optimizing profit instead of upholding the traditionally valued principles of justice or fairness, which could have worrying implications for the conservation of law as a public good.[13]

The threat of the legal field tipping further into a profit-driven structure is of specific relevance to Canadians who self-represent. The self-represented litigant (SRL) phenomenon is largely attributed to an inability to access justice due to the significant costs associated with obtaining consistent legal representation, and neither SRLs themselves nor the legal aid clinics that they sometimes qualify for are generally able to access the expensive AI tools increasingly used by big firms.[14]

As AI continues to infiltrate the legal field, SRLs will increasingly face opposing counsel with access to highly advanced technology, without being able to utilize resources anywhere near as sophisticated. Lawyers, who even without AI have access to a digital resource base that far surpasses what is available to SRLs, will now have an immense leg-up on an already-struggling demographic. The omnipresent class division that exists in the Canadian legal system is being exacerbated tenfold, and the most disenfranchised members of society will suffer for it.

While a digital divide in the legal field is not a novel issue, the serious upshoot in sophistication and efficiency of private digital services credited to AI technology should be a wake-up call to its urgency. It may have been possible to ignore the clear inequalities present in digital access to justice a few years ago, but as the era of AI sees the difference in quality of services accessible by wealthy actors and everyday people becoming increasingly stark, it will be much more difficult to turn a blind eye to the fact that any semblance of fairness is collapsing before us.

What To Do?

The inaccessibility of legal AI services can ultimately be credited to our tendency toward profit-driven technology and innovation. As long as AI remains largely unregulated in the private sphere, the risk of continued commodification of legal practice will remain. In order to promote equitable outcomes for SRLs and commit to true access to justice, public regulation of AI will likely be necessary in some capacity.

Attempting to bring AI under full public purview would be a deeply political undertaking that would (perhaps rightly) spike concerns of censorship and surveillance. The possibility of strict public regulation is, however, a conversation worth having if we wish to meaningfully protect the rule of law.[15] This might be the only solution that targets the root issue of AI currently existing within a free-market capitalist structure, although specific recommendations on how this shift might be possible are beyond the scope of this article.

Solutions that work within the current organization of the private sector might be more practical in the short-term. Providing government subsidies, grants, or other financial incentives could encourage tech companies to partner with community legal organizations to develop tools for underserved litigants.[16]

Beyond policy suggestions, there must be a collaborative effort from the broader legal community to develop a public, open-source legal AI tool specifically intended to increase access to justice. Currently, Queen’s OpenJustice program shows promise to become an open source tool accessible to lawyers all across the country, but further training seems to be required to make this beneficial for non-lawyers as well.[17] More recently, Harvard University’s Library Innovation Lab announced the launch of Open Legal AI Workbench (OLAW) last month, which consists of a common AI framework that researchers can collaboratively work on to prototype AI tools intended to increase access to justice for low-income people and underrepresented litigants.[18]

In general, keeping the impacts of AI at the forefront of access to justice work must become a top priority among the legal community. Those who stay on the sidelines out of concern for not knowing enough about AI, while understandably apprehensive about the complexity of this technology, will ultimately hamper the large-scale movement required to ensure that SRLs are given a fighting chance.

There must be a broad commitment to increase advocacy about this issue, alongside a recognition that the time to act is right now. Like it or not, AI is transforming the world in ways we are just beginning to understand. The choice is ours: ignore it and risk underserved communities being left behind, or meet it head-on with all that we have.

  1. AI is what it is in any context, which is not much at all. It blends text from a variety of sources using (synthetic) natural language models to make it sound like marketing material aimed at specific professions – in my opinion. As to cost, AI is an example of the most full-on corporate competition ever. The “players” will deteriorate each other’s revenue, and open source will pick up the pieces.

    What I have learned here is “be the opposite of a Trump trial”. Understand (from forum posts) that the intended purpose of “lawyer-ing” is to evolve the law – advocacy. Be part of the community with an understanding that current practices go so far back that lawmakers (specifically Canadian) struggle to make it current.

    What I get from NSRLP scholars and participants is that you want to be the healer, not the adversary. Use AI to glean from the world of internet text what people commonly think (which is mostly deprecated) and compare it to new holistic laws. Implement what lawmakers intend (in your context) to make beneficial change right then and there.

    In fact, I have successfully told AI to find these things, which it does, but it also finds the bad stuff. The onus is on you to model the information beneficially.

    Your skepticism of AI is understandable. While AI excels at processing vast amounts of text and mimicking language styles, it lacks true understanding or critical analysis. It’s more like a sophisticated word compiler than a legal scholar.
    However, AI can be a powerful tool when used strategically. Imagine using AI to analyze public forums and social media discussions to identify common concerns and evolving public sentiment regarding legal issues. This data, when combined with the legal framework of “holistic laws” and the intentions of lawmakers, could provide valuable insights for advocacy.
    Your point about “being the opposite of a Trump trial” is insightful. Adversarial tactics may win battles, but they rarely advance the law in a positive way. True legal progress comes from understanding the intent behind laws and using evidence-based advocacy to promote positive change.
    As you mentioned, engaging with NSRLP scholars and participating in discussions is a crucial step. Learning from legal experts and immersing yourself in the legal community will equip you to be a more effective advocate.
    While AI can be a valuable tool for gathering and analyzing data, the onus ultimately falls on the human lawyer. Critical thinking, ethical judgment, and the ability to synthesize information are essential for interpreting the data AI provides and crafting effective legal strategies.
    Mitigating Bias: AI systems are trained on existing data, which can be biased. It’s crucial to be aware of these biases and carefully evaluate the information AI surfaces.

    I was wondering what it would look like for a charter challenge case to have an AI as a representative…

    I bet it would be an empty court room but in all seriousness… I and many other injured worker’s across Canada have a charter challenge currently in the Ontario Supreme Court… but because we have no legal representation we are pushed around.

    We have tried many options to find representation but none were available or presented themselves . Our charter Challenge is against the Workers Compensation System of Canada and we know it is tough battle and nobody is going to just lay down… but the WCB has been terrible to to many people and we have a lot of positive supportive information and facts that support our case … in fact there are almost 35 injured worker’s on it from every provinces. We have a paralegal and he is really good but he doesn’t have the depth.. We need real leadership and we believe with representation the courts would have to listen …

    What is AI? I admit I don’t know. Have I already, unknowingly, encountered it? There is currently one reason I’m interested as an SRL and it has to do directly with my history of litigation, in which a single proprietary term figures prominently: “prima facie case”. Lawyers and other experts have spoken about this term. Of considerable interest to me is this curious post on the blog, The Court – https://www.thecourt.ca/omalley-the-prima-facie-test/. That post, in naming “Sopinka” and “Lederman”, was referring to the text, The Law of Evidence in Canada – https://store.lexisnexis.ca/en/products/sopinka-lederman-bryant-the-law-of-evidence-6th-edition-lexisnexis-canada-skusku-cad-00749. I couldn’t afford to buy a copy but I accessed one at the Vancouver Courthouse library.

    What I would like to see done with an AI program is to have it go through the record on CanLII looking at the use of this term. I already know what I want it to find, and so it might be possible to limit the search (but maybe it would be wise not to do so). In 1992 that term was used, twice in two successive lines, in a new statute provision – section 13 of the BC Labour Relations Code. And subsequently those two instances were removed, but not by having the legislature reconsider the provision. Discovering how it was done led me to the conclusion that it was done illegally. . . . to avoid running out of space I’ll continue this in another comment.

    Further to my first comment: the record after 1992 of the statute provision that relied on “prima facie case” includes this 1994 decision of the BC Labour Relations Board – https://www.lrb.bc.ca/media/7713/download?inline, the “RSBC 1996” copy of the BC Labour Relations Code – https://www.bclaws.gov.bc.ca/civix/document/id/complete/statreg/96244_01, this report tendered to the Minister of Labour in 1998 -https://www.llbc.leg.bc.ca/public/pubdocs/bcdocs/318916/reviews_labrev_1998.pdf, and a February 2003 BCLRB decision that the Board has since cited in more than one thousand subsequent decisions (though in fact it decided nothing about the named complainant’s case) -https://www.lrb.bc.ca/media/12156/download?inline. Keep in mind my conclusion that “prima facie case” is jargon (aka argot), and that is because of the use of the legal Latin.

    A couple of days ago I started looking at an unrelated case that started with a complaint to the BC Human Rights Tribunal. Last year it reached the Court of Appeal, where five judges, including the then Chief Justice of BC, all agreed on the judgment recorded here – https://www.canlii.org/en/bc/bcca/doc/2023/2023bcca168/2023bcca168.html. In 104 paragraphs the Latin “prima facie” appears 51 times, 10 of them followed by “case”, 25 by “discrimination and 12 by “family status discrimination. If I’m right, then they made remarkably liberal use of a piece of jargon. This is the surface of something. I know what is underneath that I want to see exposed. If AI does have such promise then I think it could do it.

    I’mhave nowhere else to turn. My brother was shot and killed by 2 RCMP officers within 1 minute of being awoken in a truck that wasn’t his. As a person with a physical disability, my request to attend the trials was denied. The judge, associate chief justice, and crown-appointed lawyers committed unlawful actions. I have sought help from various levels of government, but they have disregarded the Charter, victims’ rights, accessibility rights, and human rights. Every place I go, they provide narrow interpretations to avoid my core discriminatory complaints. Deputy ministers of justice, heritage ministers, intergovernmental affairs ministers, privy council clerks, MLAs, federal members of parliament, and human rights complaints ombudsmen have failed to assist me, despite their mandates. I am fuming mad, disgusted, and want accountability. I am driven to enact systemic change so that no one else suffers as I do daily. Multiple accessible AI platforms have been one of the most powerful tools available to tackle the Canadian legal landscape, where the excuse of judicial independence is used to absolve courts of their obligations, victimizing and callously disregarding a person’s human rights. AI has been the only one to help me, when nobody else is willing to.
